All items are sold as-is, where-is, with no warranties or guarantees. Buyers are responsible for conducting their own inspections prior to bidding.  Participation in the auction signifies acceptance of the items’ condition.

Payment by wire transfer.

Buyer’s Premium: 10% buyer’s premium is added to the final hammer price of each lot.

 

Removal Requirements

All units must be removed within 45 days of the auction closing, no later than April 14, 2026.

Buyers are responsible for all loading, equipment, and transportation. Full payment must be collected before removal.

Purchased units must be removed by the registered bidder. Buyers may not sell or consign units to a third party until removal from the auction site is complete.

 

Terms & Disclosures

Contents of buildings are not included. All contents will be removed prior to the auction closing. Electrical will also be unhooked.

Ramps, railings, steps, etc. will stay on-site and do not go with the units.

If you’ve never participated in an auction before, the process is straightforward:

  3. Attend the Preview (Recommended)
    Inspect items in person on the scheduled preview date to evaluate condition before bidding.

  4. Place Bids Online
    Submit bids anytime during the auction period until the lot closes.

  5. Pay & Pick Up
    Winning bidders complete payment and remove items during scheduled pickup dates.

REGISTRATION AUTHORIZATION: Registration authorization is required for first time bidders prior to bidding and will be authorized on your credit card. The $50.00 is held by your individual bank or credit card company according to the length of time that they hold authorizations. This is NOT a charge from the auction company and is similar to putting down a credit card to hold a hotel reservation. If you do not make any purchases, you will have no charges against your account. This authorization is separate from your purchases and will not be applied to your final payment as it is ONLY authorized and not charged to your account.

AS-IS: All items will be sold 'AS-IS' where is with all faults if any. Rogers Realty & Auction Co nor the seller make any warranty whatsoever. All sales are final. No refunds will be given under any circumstances. No exceptions!

PREVIEW: Preview units on Thursday, February 19 from 11:00am-1:00pm. Classroom units are located at Albemarle Road Elementary School, 7800 Riding Trail Road, Charlotte, NC 28208. We strongly encourage bidders to preview the assets being sold. All sales are final. No refunds will be given under any circumstances. No exceptions! Photos for online viewing and descriptions of rolling stock are not guaranteed to be correct. Buyer is responsible for determining the condition of all assets. Descriptions may change up to sale day!

PAYMENT TERMS: PAYMENT IN FULL BY WIRE TRANSFER. A 10% BUYER'S PREMIUM WILL BE ADDED TO ALL BIDS!

For wiring instructions or credit card payments call 336-789-2926 and ask for Anita, Malea or Susan. All successful bidders must be available at the conclusion of the sale to make payment arrangements. PAYMENT IN FULL BY MONDAY, MARCH 2, 2026 AT 3PM! After 48 hours the Credit Card on file at time of registration will be charged if payment arrangements have not been otherwise made. If buyer does not pay in allotted time they will be banned from future auctions.

REMOVAL: All units must be removed within 45 days of the auction closing, no later than April 14th, 2026. Modular units are located at 7800 Riding Trail Road, Charlotte, NC 28212. Units must be paid for in full prior to removal. Drivers are required to have paid receipt for load out. IF YOU CAN NOT REMOVE ITEMS WITHIN ALLOTTED TIME DO NOT BID! All articles, items or vehicles shall be removed from the sale area by the buyer at their expense. Rogers Realty & Auction Company and Charlotte Mecklenburg Schools will not provide loading or transportation. Buyers are responsible for all removal, loading, moving and hauling of all purchases. The auction company and/or the seller do not have any way of loading or transporting units. Contacts for removal assistance can be provided to buyers upon request. All items must be paid in full before removal!

Buyers may not sell, consign, transfer, or assign purchased modular units prior to full removal from the auction site.

All units must be removed by the registered buyer in accordance with the stated removal terms. Any resale or third-party transaction before removal is strictly prohibited and may result in cancellation of the sale, forfeiture of deposits, and/or denial of future bidding privileges.

RECORDS: The records of bookkeeper are final in case of a misunderstanding over the bid price.

METHOD OF SALE: Modular units are being sold with reserve.

CATALOG: The seller and auction company reserve the right to add or remove any vehicle or piece of equipment, whether listed or printed in the brochure/catalog. Although statements printed in the catalog and those made by the auctioneer have come from what is thought to be reliable sources, purchaser must understand he/she is buying property entirely upon his/her own examination and opinion from the pictures/video. The auction company is not responsible for accuracy of descriptions including, but not limited to, make, model, horsepower, MPG, serial numbers, engine type, condition or mileage. Descriptions may be changed up to auction day. No property may be removed from premises before making settlement in full day of sale. All sales will be conducted according to applicable state laws. All articles, items or vehicles shall be removed from the sale area by owner at their expense immediately following the auction.

Rogers Realty and Auction Co., Inc. reserves the right to refuse to register or to accept a bid from any person, corporation, partnership, joint venture, or other legal entity, which for any reason does not auctioneer saying 'sold' or otherwise declaring completion of sale. Thereupon the new owner assumes full responsibility for property purchased and agrees to the terms of the sale.

UNIFORM COMMERCIAL CODE: Section 2-328 of the UCC provides federal law regarding a sale by auction. The code reads that a sale by auction is complete when the auctioneer so announces by the fall of hammer or in other customary manner. A bid is a legal binding contract between bidder and auctioneer. Reopening a bid is at the sole discretion of the auctioneer. Failure to complete a payment in good faith, stopping payment on checks or refusing to pay for goods or assets purchased at auction may result in legal action against the buyer.

Qualified Bidders:
“Auctioneer reserves the right to refuse to register any prospective bidder for any reason, or to require a cash deposit from a prospective bidder of an amount designated by Auctioneer and paid in advance by the prospective bidder to Auctioneer. Such deposit will be applied to any purchases made at the auction by the prospective bidder. At the end of the auction, Auctioneer will refund any portion of this deposit that has not been applied to purchases. Furthermore, Auctioneer may terminate online bidding privileges for any reason including, but not limited to: (1) tampering with auction lots; (2) any illegal conduct including collusive bidding; (3) disruptive behavior; (4) failure to abide by these terms; and (5) intoxication. At preview and/or removal, the auction firm may ask a bidder to leave the auction site immediately and quietly upon request by Auctioneer. Any act of theft, vandalism or disruption will be prosecuted to the fullest extent of the laws.”

DISPUTED BIDS AND INCREMENTS: In case of a dispute over who is the high bidder, the auctioneer has the sole discretion to determine the high bidder.

CREDIT CARD DISPUTES: 

Credit Card Payments & Chargeback Policy: All credit card payments are subject to verification. Buyers paying by credit card may be required to provide a copy of a valid government-issued photo ID and a copy of the credit card used for payment. The name on the bidder account must match the name on the credit card and photo ID. If verification cannot be provided, Rogers Realty & Auction Co. reserves the right to decline payment or cancel the transaction.

By submitting payment, the buyer authorizes the charge and acknowledges responsibility for all charges incurred. Credit card disputes or chargebacks are not permitted once payment has been authorized and property has been released, picked up, or transferred. Any attempt to dispute or reverse a valid charge after authorization, pickup, or transfer of possession will be considered a breach of these terms and may result in legal action to recover funds.

Failure to provide requested verification may result in payment being declined, the transaction voided, loss of bidding privileges, and/or permanent suspension from future auctions.

ONLINE BIDDING: You must register in advance by clicking on Register to Bid and agreeing to terms for online bidding including submitting a credit card. The auction company may refuse to register anyone at its sole discretion. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Rogers Realty & Auction Co., Inc. or anyone else providing online bidding if the Internet service fails to work correctly before or during the live auction. Rogers Realty & Auction Co., Inc. will not be responsible for any missed bids from any source. Rogers Realty & Auction Co., Inc. reserves the right to withdraw or re-catalog items in this auction. The auction company will not be liable for any faulty equipment, failure of equipment, faulty software, failure of software, lack of internet service connections or signals, or failure for any online bids that are not relayed on time to the auction company. The seller and the auction company reserve the right to postpone, reschedule or cancel the auction for any or no reason without notice to bidders. The seller and the auction company also have the right to extend bidding or delay bidding without any notice to bidders.

AUCTION END TIMES: The online bidding is a timed event. 1 lot will close every 2 minutes beginning at 12:00pm on THURSDAY, FEBRUARY 26TH. Auction Company reserves the right to extend the auction in 1 minute segments for any and all bids received in the last 1 minute of the auction.

DEFAULT OR DELAY: The auction company reserves the right to reclaim and resale any assets not paid for by the buyer. Should the resale price be lower than the defaulted buyer's price, Seller and/or Auction Company reserves the right to seek the difference from the initial buyer. All fees for collection, court fees, or attorney fees will be the responsibility of the original buyer that caused the default. All sales are final. No refunds are given.
