Nothing in this Order or the Asset Purchase Agreement releases, nullifies, precludes, or enjoins the enforcement of any liability to a governmental unit under police and regulatory statutes or regulations that any entity would be subject to as the owner or operator of property after the date of entry of this Order.
The Trustee shall make or shall require its auctioneer to make in writing the following statement to prospective purchasers in advance of any sale of the parcels covered by the Motions: 1) The properties being offered for sale are collectively known as a “Site,” which is listed in the inventory of the Inactive Hazardous Site Branch (“IHSB”) of the North Carolina Division of Waste Management, file # NCD003213030 (IHSB contact: Ms. Bonnie Ware, (336) 771-5356); 2) The IHSB has a file concerning contamination by hazardous substances of portions of the Site, which prospective purchasers are advised to review; and, 3) Additional assessment of all parcels is needed and remediation of some or all parcels may be required, so complete environmental due diligence is recommended prior to bidding on or purchasing any parcel.
